Kelly Allen case going to Grand Jury. Twenty-eight year old Kelly Allen will have his case heard before a grand jury. Allen and his defense attorney Don Thomas appeared in Marshall County District Court yesterday. Allen is accused of shooting 38 year old Jeremy Scott on May 31 at Allen’s residence on the Bottom Road. Allen previously told investigator’s that he heard an ATV near his anhydrous ammonia tank after confronting someone the day before who was stealing from the tank. Allen also said he fired two shots into the air from his .38 revolver. Allen said the ATV left the scene and then stopped a short distance away. Allen went to check on the driver and found a bullet wound. Allen has been charged with reckless homicide in the case. Marshall County’s next Grand Jury will convene on August 14.
