Kentucky’s Seasonal Burn Law Expires, Open Burning Now Permitted Statewide

(FRANKFORT, Ky.) — Kentucky’s seasonal burning restrictions officially expired on December 15, allowing residents across the state to conduct open burns at any time, according to state regulations.

The annual burn law, which typically restricts open burning during certain months to reduce wildfire risk, has now lifted its time-based limitations. However, state officials emphasize that strict guidelines remain in place regarding what materials can be legally burned.

Under Kentucky law, only approved natural materials may be used for open burning. Prohibited items include household trash, plastics, treated lumber, and other restricted materials. Violating these material restrictions can result in fines and penalties.

Fire safety officials are urging residents to exercise extreme caution when conducting any burning activities. All fires must be actively supervised and should never be left unattended. Residents are also advised to carefully assess current weather conditions and proximity to buildings or other structures before igniting any fire.

“Even though the seasonal restrictions have expired, weather conditions should always be a primary consideration,” Curt Curtner of the Marshall County Emergency Management Agency stated. During periods of drought or high winds, authorities recommend postponing burning activities entirely to prevent uncontrolled fires.
