
BENTON – Marshall County Fiscal Court met in regular session Tuesday, August 18, 2016.
Juli Conner with the Marshall County Health Department spoke to the court about their mosquito spraying service for those who contact the Health Department. In may they sprayed 54 properties, down to 28 in June and 26 in July.

For the month of August so far they have provided spraying for 80. This is a community service the Health Department provides. For more information call the Marshall County Health Department.
Lisa Carter, Assistant County Attorney, spoke to the court concerning guardianship fees, a division that serves county citizens that find themselves at risk or harm either due to circumstances at birth, accidents or old age, where they or their families are in a position that they can no longer make informed legal decisions.
This requires a jury trial and petition filed in district court. These hearings appoint guardians and conservators to protect their rights. They are evaluated by a 3-person team; a medical doctor, a certified licensed psychologist and certified social worker and are also appointed an attorney.

If they are indigent and do not have money, it falls to the county to pay for those services that evaluate them and attorney fees.
A certified Psychologist was previously provided by Four Rivers but currently do not, which has caused a back up in this division. The statute says the county “shall” pay so Carter wanted to inform the court of their responsibility so they are aware when a bill arrives for this service, which runs approximately $350 per case.

Hope Clinic
The Hope Clinic will hold their fund raising banquet September 19th or 20th at the Kentucky Dam Convention Center at 5:45 PM. RSVP by September 5th.
Kentucky Transportation Cabinet
The Department of Rural and Municipal Aid receives a large amount of emergency funding requests each year and due to files have not being closed out, some dating back to 2007, it has become necessary for them to change the method of emergency funding payment disbursement. Beginning September 1st, 2016, any payments approved after this date with be paid as follows; initially 50% of the approved amount will be distributed following the completion of the project. After final costs have been determined and submitted and processed, the determined remaining amount will be distributed.

Building Fee Ordinance amended schedule 2nd reading was accepted.
Shar-Cal Road Bridge Removal
Sealed bids were opened for removal of the 60 foot timber bridge. Three bids were received from Greer Excavating Service in the amount of $35,000, Land Works Group bid $39,581 and Jim Smith Contracting bid $23, 281.26. A discussion was held concerning possibly leaving some of the sheet piling to prevent erosion until the bridge is constructed. Specifications were for all removal and disposal of bridge materials. It was determined that the Jim Smith Contracting bid was non-conforming. The court approved the bid of Greer Excavating Service.
Nuisance Board
Initial terms on the Nuisance Board are staggered. Bill Fletcher was approved to a 3-year term, Ken Azarela was approved to a 2-year term and an appointee from Hardin will serve a 1-year term.
NEW BUSINESS
Time-clock Plus Software Quote
The quote in the amount of $12,294 with an annual cost of $5,400 per year licensing fee, for time-keeping software, was approved by the court.
Ordinance #2016-10
The 1st Reading of the Inter-local Nuisance Agreement for the county and city of Hardin was approved. The ordinance reflects an inter-local agreement between the Fiscal Court and Hardin that creates a nuisance code enforcement board to combat nuisance properties in the county and city of Hardin.
County Wide Surplus
Surplus property in the county will be moved to the county maintenance facility to be auctioned off on Saturday, September 17th. An list will be available in the Judge’s office with a partial list of items to be auctioned.
Drainage Issues
Memorandums of agreement related to four private properties that effect the roadways and need drainage work were approved by the court.
Wacker Chemical
Josh Tubbs addressed the court concerning a tax resolution for Wacker Chemical from a project that received preliminary approval October 25, 2012. A building was constructed to house a new reactor which created 15 jobs. The city of Calvert and the Marshall County Fiscal Court will provide a 1% tax break, .5% from the city and .5% from the county.
Tax Rates
County Treasurer Emily Martin explained the process of creating the tax rates.
Audit Quotes
The Fiscal Court will not participate in the state Request for Proposal (RFP) when the state informs the county they are not doing their audit. Doing this will allow the county to have a consistent audit from year to year by using the same auditor. Emily Martin has received quotes from four of the seven she reached out to for quotes and asked the commissioners to review them.

Dennis Foust
Dennis Foust was sworn in as an Assistant County Attorney by Judge Kevin Neal. Foust has agreed to offer services to assist the County Attorney’s Office.
EXECUTIVE SESSION
The court went into Executive Session to discuss a possible land acquisition, personnel and litigation.
