BENTON – Fiscal Court got down to business on a snowy Tuesday, February 17th, hearing from several guests including Howard Dawes, Jr. who presented the court with a Resolution titled Marshall County Judge Executive Mike Miller Memorial Anti Right-to-Work Resolution.

Correspondence
The Department for Environmental Protection Division of Waste Management informed the Fiscal Court that the Recycling Grant in the amount of 77,300 awarded in June 2014, that grant funds have been appropriately and full expended and the court was successful in meeting the required match, according to the 2nd Quarter report
Mercy Regional EMS informed the court of its intent to obtain certificate of need approval to establish in Marshall County a Class III advanced life support ground ambulance service that will provide critical care, emergency, or non-emergency transportation between health care facilities.

Old Business
During the January 20th meeting of the Fiscal Court, the Kentucky Lake Motor Speedway presented their 2015 schedule and requested their curfew be moved from 11:30 to 12 midnight for the upcoming season, especially with the larger Friday/Saturday series they will be hosting this season.
David Green, KLMS spokesperson, said they feel they have earned the respect of the community by adhering to their 11:30 p.m. curfew last season and that the new curfew requested is solely to be able to finish a race should it not be completed at the stoke of 11:30 p.m.
The court tabled a decision on adjusting the curfew at that meeting, stating their decision Tuesday that they will not approve an overall time change and will continue to require the 11:30 p.m. curfew as determined in the original entertainment permit.
The court did approve nine of the 16 variances requested and stated that KLMS will need to decide which nine of those 16 events they will apply the approved curfew of midnight to.
The court stated that these variances are to accommodate KLMS a way to get the larger money making events into the area and want them to be successful in bringing economic growth to KLMS and our county.
New Business
Bids were opened for surplus property, audio/video equipment and a dump truck. A bid was accepted for a new tandem dump truck from TAG Truck Center in Calvert City in the amount of $104, 282.
A Road Fund Stabilization Resolution was approved to ensure adequate funding of the state road fund and country road aid throughout Kentucky. The Resolution stated that safe roads are deemed an essential public service to all drivers, stabilizing Kentucky’s road fund is vital to providing safe roads, the need to ensure state and local road safety and avoid increased strain on state and county budgets which has been a top priority in the last two legislative sessions.
The Fiscal Court supports this Resolution and encourages the General Assembly to enact Road Fund Stabilization as soon as possible.
A North Marshall Water District Resolution was read acknowledging the acceptance of certain county roads the District would be authorized to construct, operate, repair and maintain water utilities under, along or over county roads and repair any roads damaged while running water lines.
Nineteen roads and right-of-ways associated with the project are accepted in the county road system and authorized for the District to construct, operate and maintain water lines.
Sheriff Kevin Byars presented his 2014 tax settlement with Total Receipts and Total Disbursements amounting to $2,042,301.65 which the court approved. The Sheriff turned in a fee settlement check in the amount of $149,577.60 of which the court authorized the Sheriff to keep up to $60,000 for vehicle and equipment installation.
The court approved an elected officials cost of living pay increase of 0.7568%.

A Sheriff’s budget workshop was scheduled for March 3rd following the court meeting.
The Park Board had hired Krista Gerland to replace the late Barbara Parish at the park office.
The next meeting of the Fiscal Court will be March 3, 2015.
