King arrested on new charges

A local funeral home owner accused of felony fraud is facing additional charges after police say he passed cold checks to a McCracken County business.

According to an arrest report, Marshall County Sheriff’s deputies at 10:51 a.m. Saturday, Jan. 6, served an arrest warrant on Tim King, owner and operator of Filbeck-Cann and King in Benton, on suspicion of theft by deception. Court documents say between July 22 and July 28, 2017, King wrote two checks to Golfmart in Paducah, one for $740.81 and another for $1,216.19, without sufficient funds to cover those checks.

King was arrested and held on a $1,500 cash bond, which he later posted. He is scheduled to appear at 9 a.m. Jan. 23 in McCracken County District Court.

The charges are the latest in a series of those filed against King since he and wife, Becky, were accused and indicted last year. A Marshall County grand jury on Sept. 12 returned indictments on two felony counts of fraudulent insurance acts over $500, one felony count of theft by unlawful taking or disposition all others, $10,000 or more but under $1 million and one felony count of second-degree criminal possession of a forged instrument. The Kings also face two misdemeanor charges of fraudulent insurance acts $500 or less.

The Kentucky Department of Insurance (KDI) and Kentucky State Police conducted a search on the Kings’ property and funeral home in early May in response to a referral from Investors Heritage Insurance in February alleging that the Kings had collected money for pre-need burial policies and did not forward the payments and applications to secure those policies.
Investigators believe the activities took place at varying points from 2007 through 2016 and totaled more than $311,000.
Marshall County Circuit Judge Jamie Jameson recused himself from the case due to former employment in a division affiliated with KDI. Graves County Judge Tim Starks has been appointed to preside over the case. The Kings were scheduled to appear for a status hearing Feb. 5 in Graves County Circuit Court.
